Domestic Travel

Article 1 (Purpose)
This term is a purpose of matters to be observed and detailed implementation of domestic travel contract for travelers and premium tour Inc.

Article 2 (Obligation of Company and Travelers)
1. Our company will carry out the duties of arrangement of travel and tours, guides, transportation, accommodation, establishment of travel planning and the process faithfully to provide a safe and satisfied travel service to the travelers.
2. Travelers must actively participate to maintain order for tour operator and promote the harmony among travelers for safe and enjoyable trip.

Article 3 (Definitions of Terms)
Travel type and definition as below,
1. Personalized travel: Conducting the travel for the travelers demanded travel condition.
2. General recruit travel: Conducting the travel of recruiting the travelers in accordance with our company established travel condition.
3. Consignment travel: Conducting the travel with our company’s travel product by other travel agency consigning the recruit of travelers.

Article 4 (Contract organization)
Travel contract is contents of a contract about travel written agreement (Attached), terms of travel and itinerary (travel manual) In the itinerary (or the travel manual), the schedule of travel implementation such as travel schedule of tourist attraction by date, tour information, transportation, shopping times, accommodations as well as providing service contents of the travel agency and travelers caution should be included.

Article 5 (Special contract)
Our company and travelers can make a special contract in writing within the range of not violating the related laws and regulations. In this case, the company should explain to the travelers about the difference of standardized agreement.

Article 6 (The issue of Agreement and Terms)
Our company will issue each form of itinerary (or the travel manual), travel terms, and contract agreement after when we make a contract with travelers.

Article 7 (The considered issue of Agreement and Terms)
Our company is considered to issue the itinerary (or the travel manual), travel terms, and contract agreement to the traveler
1. The Company shall issue to the Traveler a document mentioning the itinerary, the contents of Travel Services, the travel fee, and other conditions for the travel and matters concerning the responsibility of the Company (hereinafter referred to as "Contract Document") promptly after the conclusion of the contract as established in the preceding Article.
2. The scope of the Travel Services for which the Company assumes the obligation to make arrangements and manage the itinerary under a Tour Contract is according to what is mentioned in the Contract Document referred to in the preceding Paragraph.

Article 8 (Company responsibility)
In performing the Contract, if the Company or the person whom the Company has had makes arrangements as an agent in accordance with the provisions of Article has caused damage to a Traveler intentionally or by negligence, the Company shall bear the responsibility for compensating for the damage.
If a Traveler has incurred damage due to a natural disaster, a war, a riot, the suspension of the provision of Travel Services of transportation and accommodation facilities, etc., an order of a government or other public offices, or any other event in which the Company is unable to intervene, the Company shall not be responsible for compensating for the damage except in a case referred to in the preceding Paragraph, shall prevail over the provisions of these General Terms and Conditions. By booking your arrangement with us or using our website, you are agreeing to be bound by the terms of this Agreement, and any additional terms and conditions of any Supplier that are applicable to your booking, travel arrangements or use of any website content. You agree on behalf of yourself and those you represent to comply with all such terms and conditions, including the payment of all amounts when due. You agree that any violation of any such terms and conditions may result in (a) the cancellation of your reservation or purchase, (b) your forfeiture of any monies paid for your reservation or purchase, (c) you being denied access to the applicable travel related product or service, and (d) our right to debit your account for any costs we incur as a result of such violation.
You represent and warrant that (a) you are of sufficient age to use our services and website and can create binding legal obligations in connection with your use, (b) you are legally authorized to act on behalf of those you represent and accept these terms and conditions on their behalf, and (c) the information supplied by you or members of your group is true and correct. You are responsible for informing such other persons of all terms and conditions applicable to their travel arrangements. You understand that you are financially responsible for any use of our services or website by you and those using your name or account.

Liability:
The Company hereby expressly represents that is acting as an intermediary between travelers and entities or persons providing the services described in the itineraries. Consequently, the Company shall not be liable for any deficiency, nor for any accident, damage, injury, delay or irregularity in the services provided, nor for the luggage and other objects belonging to the travelers.
The Company makes every effort to keep all information posted on the website updated; however, neither the Company nor Premium Tour shall be liable for damages resulting from any errors and omissions in the information provided on the website.
The Company hereby disclaims any liability resulting from any delay, advanced departure or cancellation established by airlines or other carriers, and any and all costs arising there from shall be borne by travelers.
The Company assumes no liability for hotel grading criteria or hotel compliance monitoring. Tour packages and itineraries sent to travelers show hotel grades as officially assigned by local tourism authorities.
The Company does not guarantee the handling of baggage and personal items, and travelers assume complete and full responsibility therefore. Travelers are therefore advised to obtain appropriate travel insurance coverage against this risk.
The Company assumes no responsibility by reason of bad weather conditions, demonstrations, riots, war or war rumors, or any Act of God or force majeure events outside the control of either party that may adversely affect the tour.
The use of air or land transportation by travelers implies a direct relationship between carrier/s and travelers. Travelers are advised to obtain flight cancellation insurance.

Article 9 (Cancellation of a contract for unfulfilled Minimum number of event)
1. Cancellation of travel contract due to the required minimum number of travelers not fulfilled; our company must give a notification to the travelers before 24 hours of departure date or before 48 hours in case of over one day two nights. 2. If our company does not notify the information of required minimum number of travelers is not fulfilled and cancel the contract, 100% amount will be reimburse to the traveler excepting of the refund of the down payment.

Article 10 (Contract rejection)
Our company can reject the traveler’s contract if there is a reason as below
1. When interrupting the amicable implementation of travel or causing trouble to other travelers
2. When traveling is impossible by illness or other reasons
3. When people exceed the maximum number of event specified in the contract

Article 11 (Travel Fee)
1. Information below is included in basic rate. Personalized travelers must subject to agreement between the parties.
a. Fare of transportation facilities such as aircraft, ships, railroad transportation (basis in general fare)
b. Bus pickup fee of the distance between airport, station, port, and hotel etc
c. Accommodation fee and charges of meal
d. Guide fee
e. Various taxes needed while traveling
f. Domestic airport and port fees
g. Admission fee of tourist attraction in the itinerary
h. The cost according to the other individual contract
2. Travelers must pay the down payment (the amount noticed as down payment of travel payment) to our company when signing the contract and down payment will be deal as a travel fee of whole or in part of compensation of damage
3. As section 1, travelers must pay the balance (except the amount of the down payment for travel fee) until the day before the departure
4. As section 1, travelers must pay the travel fee by the designated method (electronic billing system, deposit without a bankbook etc,.) of our company
5. Our company must explain the name of insurance company, information of compensation when the traveler’s insurance fee included in personalized travel fee

Article 12 (Change requirement of travel condition and payment)
If a natural disaster, a war, a riot, the suspension of the provision of Travel Services of transportation and accommodation facilities, etc., an order of a government or other public offices, the provision of transportation services not scheduled in the original service plan, or any other event in which the Company is unable to intervene has occurred, and if it is unavoidable in order to secure the safe and smooth implementation of the travel, the Company may change the itinerary, the contents of Travel Services, or other contents of the Contract (hereinafter referred to as "Contract Contents"), having explained promptly in advance to the Traveler the reason that the event concerned is one which cannot be intervened in and the causal relation with the event concerned; provided, however, that in case of emergency and if it is unavoidable, such explanation will be given after the change has been made.

Article 13 (Contract cancellation before travel)
The Company may cancel the Contract before the commencement of the travel explaining the reason to the Traveler, in any of the following cases:

(1) If it has become clear that the Traveler does not satisfy the conditions for a participating
Traveler in respect of sex, age, qualifications, skills, etc., which the Company has specified in advance;
(2) If it is considered that the Traveler is not fit for the travel concerned for reasons of illness, absence of a required assistant or other reasons;
(3) If it is considered that the Traveler may give trouble to other travelers or disturb the smooth conduct of the group travel;
(4) If the Traveler has demanded a burden exceeding the reasonable extent in connection with the Contract Contents;
(5) If the number of travelers has not reached the minimum number of participants mentioned in the Contract Document;
(6) If there is a great possibility that the conditions for the operation of the travel, such as the required amount of snowfall in case the travel is for the purpose of skiing, which have been specified at the time of concluding the contract, will not be fulfilled;
(7) If a natural disaster, a war, a riot, the suspension of the provision of Travel Services of transportation and accommodation facilities, etc., an order of a government or other public offices, or any other event in which the Company is unable to intervene has occurred, and the safe and smooth operation of the travel in accordance with the itinerary mentioned in the Contract Document has become impossible, or there is a very large possibility of such impossibility arising;
(8) If, in a case where a Communications Contract has been concluded, the Traveler has become unable to settle his/her debts relating to the travel fee, etc., in whole or in part, in accordance with the card membership rules of the Affiliated Company, for such reasons as the Traveler's credit card being invalid, etc.

Article 14 (Contract cancellation after travel)
1. Our company or travelers can cancel the contract after departure if there are unavoidable circumstances. But, the compensation for the damages of other party must be paid
2. As section 1, in this case of the contract cancellation, our company shall help and cooperate for the travelers return and travelers will be responsible for these necessary expenses.

Article 15 (Beginning and closure of travel)
The start of the travel is by the departure point and the travel is ended at the arrival of final destination. The change of contract and schedule is exceptional.

Article 16 (Obligations of explanation)
Our company must explain the important information and changes of this provision of terms and condition so that travelers can understand

Article 17 (Insurance)
Travel insurance is a vital part of your arrangements. We strongly recommend that you have taken out adequate insurance for the duration of your journey. Travel insurance is a mandatory element of some travel arrangements. We may be able to arrange travel insurance to be provided to you, furnish you a quote, and answer any queries you may have regarding the insurance.

Article 18 (Other Applicable Provisions)
1. In case of matters not stated in this contract or conflict of interpretation of this contract, our company and traveler will make a decision by concurrence in opinion. If it’s impossible to agree to this matter, we will follow the relevant laws and regulations,
2. Information of our company’s travel terms and condition might be different in case of a trip to a special area by a legitimate reason.

b. Contract cancellation by traveler’s reason
(In case of a day trip)

- Cancellation received 1 day prior to commencement of services⇒ 20% of total price
- Cancellation received on departure day or no show ⇒ 30% of total price

(In case of travel accommodation)
- Cancellation received 5 days prior to commencement of services ⇒ Full refund
- Cancellation received 2 days prior to commencement of services⇒ 10% of total price
- Cancellation received 1 day prior to commencement of services⇒ 20% of total price
- Cancellation received on departure day or no show ⇒ 30% of total price

c. Travelers contract cancellation due to the violation of contract conditions by travel agency (Before travel)
(In case of a day trip)
- Change received for the contract condition 3 days prior to commencement of services ⇒ deposit refund

- Change received for the contract condition 1 day prior to commencement of services

3. Travelers damage due to the travel agency or travel professional mistake/ willful negligence ⇒ Travelers compensation for damage.
4. Damage of baggage loss, travel theft and other accidents, during travel ⇒ Travelers compensation for damage.
5. Delay of travel schedule or unaccomplished transportation by travel agency’s mistake/ willful negligence ⇒ Travelers compensation for damage

(7) If a natural disaster, a war, a riot, the suspension of the provision of Travel Services of transportation and accommodation facilities, etc., an order of a government or other public offices, or any other event in which the Company is unable to intervene has occurred, and the safe and smooth operation of the travel in accordance with the itinerary mentioned in the Contract Document has become impossible, or there is a very large possibility of such impossibility arising;
(8) If, in a case where a Communications Contract has been concluded, the Traveler has become unable to settle his/her debts relating to the travel fee, etc., in whole or in part, in accordance with the card membership rules of the Affiliated Company, for such reasons as the Traveler's credit card being invalid, etc.

Article 14 (Contract cancellation after travel)

c. Travelers contract cancellation due to the violation of contract conditions by travel agency (Before travel)

3. Travelers damage due to the travel agency or travel professional mistake/ willful negligence ⇒ Travelers compensation for damage.
4. Damage of baggage loss, travel theft and other accidents, during travel ⇒ Travelers compensation for damage.
5. Delay of travel schedule or unaccomplished transportation by travel agency’s mistake/ willful negligence ⇒ Travelers compensation for damage
